Terms and Conditions

The following Terms and Conditions (hereinafter, “T&C” or “Agreement”) govern the legal relation between Real Estate Los Guayabos Ltda., a Costa Rican company with registration number 3-102-487753, domiciled in San José, Curridabat, 11801, (hereinafter, “Company”) owner of www.crnomads.com (hereinafter, “CR Nomads” or “Website”), and the User of this website (hereinafter, “Nomad” or “User”).

Glossary

For the purposes of these T&C, the following words shall have the following definitions:

Services: Content, advertising, and any functionality available on the Website to facilitate Users in connecting with Service Providers.
Service Providers: companies or professionals previously identified, verified, and validated by the Company, who wish to connect with Users and offer them their services on Website.
User or Nomad: Any natural person with the legal capacity, who visits, browses, and accesses www.crnomads.com and its Services, with the intention of contracting the services offered by Service Providers.1.- Declarations and scope of these Terms and Conditions

1.1.- These T&C establish the obligations and rights of the User in utilizing CR Nomads and their Services. Therefore, the User declares that understands, comprehends, and voluntarily accept without limitation or restriction, the following T&C, as well as other policies and principles incorporated therein. Any person who does not accept these T&C, which are mandatory and binding, must refrain from using CR Nomads.

1.2.- By using the Website and its Services, Users agree to be bound by these Terms and Conditions. To access and utilize the Services, Users must be over 18 years of age; individuals under 18 are not allowed to use CR Nomads.

1.4.- Users don’t need to undergo a registration process to access the Services, but they must provide their personal data to contact the Company and obtain more information about the Services on CR Nomads and offers posted by Service Providers. All the personal data will be processed according to the Privacy Policy of CR Nomads.

2.- About the Services

2.1.- CR Nomads is a web platform designed for “digital nomads” or “working travelers” from the United States and Canada. Through our Services, Users can connect with third-party Service Providers to fulfill their needs according to their lifestyle. As such, Users will have access to the following benefits on the Website:

Digital content and advertisements showcasing services provided by Service Providers, including workspaces, accommodations, tours, transportation, insurance, legal services, and various others that CR Nomads may incorporate in the future, catering to the User’s lifestyle.
Features enabling users to connect with Service Providers for requesting further details about the services showcased on the website.
Accurate information on traveling, workspaces, tourism and more every week in our blog section.

2.2.- To use CR Nomads, Users must have access to a desktop computer running Windows, Mac, or Linux operating systems, equipped with any compatible web browser such as Google Chrome, Mozilla Firefox, Microsoft Edge, Brave, Safari, among others. Users can also access the Website from a mobile device running iOS or Android operating systems, provided that a functional web browsing application is installed and operational.

2.3.- CR Nomads may be accessed from any location worldwide; however, the governing legislation for this Agreement is that of Costa Rica.

2.4.- The User acknowledges that the functionalities and services outlined in this clause may be expanded and/or limited by the Company, at its sole discretion, in accordance with its policies and technological and commercial development plans. Any such modifications will be communicated to the User through the platform.

3.- General Conditions

3.1.- Some of the content featured on CR Nomads may be related with services provided by third-party entities. These entities have been vetted and maintain a commercial relationship with the Company. Nonetheless, the User acknowledges that the responsibility for the provision of such services and products lies solely with the respective Service Provider. However, the User shall report to info@crnomads.com any suspicious, fraudulent, or deceptive activity by Service Providers.

3.2.- When the User contacts CR Nomads or any of the Service Providers advertised on CR Nomads, they are obligated to provide truthful and accurate information. If the Company detects that the User is using fake or fraudulent information, or impersonating another person’s information, the Company may proceed to block the User’s access to the Website and take legal actions deemed necessary according to the case and the laws of Costa Rica.

3.3.- If the Company deems it necessary, it may request additional documentation and information from the User to verify their identity, which will be requested via email or through a phone call. If the User fails to provide the requested documentation and/or information within seventy-two hours of the request being sent, access to the platform may be suspended by CR Nomads.

3.4.- We reserve the right to modify or update information and rectify any errors in the content at any time without prior notice to Users.

4. – Information Security

4.1 – The Company is committed to adhering to the highest standards of information security and industry best practices, in accordance with the identified risks, ensuring that CR Nomads platform maintains the confidentiality, integrity, and availability of user information. In pursuit of this objective, the Company has implemented an SSL – Let’s Encrypt security certificate on its server, ensuring that information exchanged between the user’s device and the CR Nomads server is transmitted via a 256-bit encrypted connection, utilizing TLS 1.3, thereby safeguarding the data against unauthorized access by third parties.

4.2 – The Company is not obligated to be held accountable for acts or omissions that may arise from any User, including falling victim to phishing, social engineering, malware, trojans, backdoors, spyware, adware, ransomware, or any other malicious application that impacts the functionality of the User’s device or unlawfully intercepts, monitors, duplicates, or accesses the User’s software or hardware.

4.3 – The User expressly understands and accepts that, due to the nature of these non-face-to-face transactions, there are inherent risks of fraud, identity theft, widespread illegal attacks on devices and servers, and other situations beyond the control of the Company. Therefore, Users must always remain vigilant, ensuring they are on the correct URL associated with the Website, and REFRAIN FROM PROVIDING PERSONAL INFORMATION TO INDIVIDUALS NOT AUTHORIZED BY CR NOMADS.

4.4 – With regards to security and management of personal data, User agrees to adhere to the following:

Use the Website only for legal purposes.
Notify CR Nomads via email at info@crnomads.com of any suspicious messages or websites utilizing the CR Nomads brand, which may indicate impersonation due to their appearance or lack of credibility. This includes instances where electronic messages request financial information, security codes sent to the User’s devices, or any other personal information deemed confidential by the User. CR NOMADS STAFF WILL NEVER REQUEST FINANCIAL OR SENSITIVE INFORMATION FROM THE USER. If such information is required for legitimate purposes, it will only be communicated through official CR Nomads channels.
Use secure devices for browsing and utilizing CR Nomads, ensuring the presence of licensed software, antivirus, and security tools on both computer and mobile devices. This proactive measure aims to prevent attacks from malware, viruses, trojans, keyloggers, botnets, spyware, adware, ransomware, and other malicious programs that may compromise the security of the User’s personal data.”

5.- Prohibited uses

The User acknowledges and accepts that the following actions are strictly prohibited for them or any third party:

Sell, resell, license, sublicense, distribute, or make CR Nomads available to third parties, rent, or lease it.
Use CR Nomads for any commercial purposes other than those explicitly indicated in these T&C.
Employ CR Nomads to store or transmit any illegal, immoral, illicit, and/or unauthorized material, or to interfere with or violate a third party’s rights to privacy and other rights, or to harvest or collect personally identifiable information about third parties without their express consent.
Utilize CR Nomads to transmit or make malware available on the Internet, including viruses, worms, Trojans, web bugs, spyware, or any other malicious code, file, or computer program.
Attack the integrity, performance, or operation of CR Nomads or any of its components.
Attempt to gain unauthorized access or circumvent any measures imposed to prevent or restrict access to CR Nomads and its features or services.
Utilize web scraping techniques to capture, collect, duplicate, copy, process, extract, or mine data and information available on CR Nomads.
Employ web scraping techniques to capture, collect, duplicate, copy, extract, process, or mine data and information published on CR Nomads to train Artificial Intelligence models.
Copy, modify, distribute, create derivative works, translate, port, reverse engineer, decompile, or disassemble any software component that is part of CR Nomads.
Engage in fraudulent, illicit, unauthorized acts, or acts not outlined in these T&C that threaten the assets, rights, or interests of CR Nomads or the Service Providers.

6.- Prohibited content

6.1.- CR Nomads provides functionalities through which the User can contact or send messages to the Company, or third parties advertised on the Website, such as forms, chat buttons, email, or CR Nomads’ social media profiles. The User, by utilizing any of these functionalities, agrees not to transmit, disseminate, upload, or publish material in any manner that adversely affects the reputation or goodwill of the Website, or interferes with its normal operation. This includes content that may detrimentally impact the brand and standing of CR Nomads in the market or its business partners. Prohibited content encompasses material that is defamatory, pornographic, illegal, indecent, offensive, or threatening in nature, violates applicable laws, infringes upon copyright or property rights, intrudes upon the privacy of other Users, contains viruses or malicious code, or disseminates false or misleading information regarding the origin of the material or communication.

The User engaging in the described conducts in the preceding paragraph shall be held liable criminally, civilly, and administratively for any damages inflicted upon the Website, the Company, or any affected third party. Moreover, the Company will employ appropriate legal measures to halt any unlawful activity impacting the operation of the Website.

6.2.- This Website may contain links to external websites or other resources that are not controlled by the Company, therefore, the Company assumes no responsibility for the terms and conditions, privacy policy, features, content, or the services of any third-party website. The User’s responsibility is to ensure they are visiting a legitimate and safe Internet site after leaving this Website, and agree that Company shall not responsible or liable, directly, or indirectly, for any loss or damage related to the use of their websites.

7. – Intellectual Property

7.1 – All materials, including brands, texts, videos, photographs, images, software, source code, web page design, graphics, platform interfaces, as well as other creations recognized as eligible for copyright and/or industrial property protection by law, are solely owned by the Company or have obtained requisite permissions from third parties for their usage. Consequently, they may not be reproduced, copied, pasted, linked, transmitted, distributed, manipulated, or used in any manner without prior written authorization from the Company. Using web scraping techniques to capture, collect, extract, or process information, or to mine data and information published on CR Nomads is strictly prohibited without authorization from the Company.

7.2 – The Users acknowledge and agree that by using or visiting CR Nomads, they do not obtain any license, rights transfer, patent transfer, or authorization for the exploitation or disposal in any form of the intellectual property or digital assets incorporated in CR Nomads. Any violation by the User of the provisions of this clause will empower the Company to promptly disable access to the Website and pursue legal actions deemed appropriate to enforce corresponding civil and criminal liabilities.

7.3 – The User is permitted to reproduce, in whole or in part, and share information related to the CR Nomads Services via any electronic or physical means for the purpose of promoting the Website’s Services. However, this reproduction and sharing must include a hyperlink to the CR Nomads Website or its social media profiles. Neither the User nor any individual other than representatives of CR Nomads are authorized to market the CR Nomads platform or its associated services. Any unauthorized use or modification of the material or content for purposes other than those explicitly authorized will be deemed a violation of the laws of the Republic of Costa Rica and international laws governing intellectual property rights.

7.4 – Non-compliance with the provisions outlined in this section will grant the Company the right to pursue damages from the User. Additionally, the Company reserves the right to pursue any criminal, commercial, civil, or administrative liabilities, if applicable, in accordance with the legislation of the Republic of Costa Rica.

7.5.- Any user who believes that their copyrighted material is being used on CR Nomads in a manner that constitutes copyright infringement may contact the Company at info@crnomads.com.

8.- Limitation of Liability

8.1.- CR Nomads shall not be held accountable for the availability or any potential failures occurring on the server or in the operation of the Website that may render access to the Services impossible. It is explicitly stated that CR Nomads, relying on third parties to deliver its services over the Internet, does not guarantee or accept responsibility for system issues or limitations affecting the Website’s use. Additionally, CR Nomads is not liable for any transactions and/or services that cannot be conducted or provided due to platform issues or interruptions beyond CR Nomads’ control.

8.2.- THE COMPANY OFFERS AN INTERMEDIATION SERVICE AND THEREFORE ASSUMES NO RESPONSIBILITY REGARDING THE DESCRIPTION OF SERVICES AND PRODUCTS OFFERED BY SERVICE PROVIDERS, INCLUDING DESCRIPTIONS, PRICES, SCOPES, LIMITATIONS, OR RISKS. THE USER ACKNOWLEDGES AND AGREES THAT THE COMPANY SHALL NOT BE HELD LIABLE FOR ANY SERVICES OR PRODUCTS CONTRACTED BY THE USER WITH ANY SERVICE PROVIDERS. IN NO EVENT SHALL THE COMPANY BE LIABLE TO THE USER OR ANY THIRD PARTY FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, OR IMPLIED, INCLUDING, WITHOUT LIMITATION, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES ARISING IN CONNECTION WITH THE SERVICES. WE DISCLAIM LIABILITY FOR ANY DAMAGE OR INJURY ARISING FROM THE ACTIONS OF SERVICE PROVIDERS OR FROM ANY TRANSACTION OR ENGAGEMENT BETWEEN THE USER AND THIRD PARTIES ADVERTISED OR PROMOTED ON CR NOMADS.

9.- Governing Law and Dispute Resolution

Any dispute arising from these T&C and their integral parts will be resolved through the courts of Costa Rica and/or the relevant authorities in matters of consumer protection, where applicable.

10.- Modifications to these T&C

The User acknowledges that these T&C may be reviewed and modified by the Company at any time, with a new version being published on CR Nomads. It is understood that the Company is not obligated to individually notify the User of any changes, but rather that they will be published on the Website for their awareness.
